Batavia police reports, Aug. 2-3 and Aug. 7
TUESDAY, AUG. 7 Two 19-year-old Batavians are headed to court after an incident on the city's west side. Austin S. Lewis, of the 1200 block of Bradford Circle, and Noel M. Gaspari, of the 500 block of Cypress Avenue, were each issued notices to appear in court for unlawful possession of an alcoholic liquor, according to a police report. The incident occurred at 12:31 a.m. on the 0-99 block of Western Avenue. According to police, Lewis and Gaspari were passengers in a vehicle that was pulled over for speeding. The driver received a warning. The officer said he noticed an odor of alcohol and had the driver and the passengers take a portable breathalyzer test. Two liquor act violations reported in Geneva involve a Batavia youth also cited for retail theft and a Geneva youth caught drinking on Randall Road, according to reports. Retail Theft, Illegal Consumption—Geneva police arrested Andrew Swidenbank, 18, of Batavia on charges of retail theft and illegal consumption of alcohol by a minor around 9:06 p.m. July 19 at Dominick’s, 2000 South Randall Road, Geneva, reports said. Police say Swidenbank took two 750 milliliter bottles of Captain Morgan spiced rum. He has a court date of Aug. 7 at the Kane County Branch Court, 530 S. Randall Road, St. Charles. A judge rules in June to quash evidence due to an unlawful search of the Robert M. Caruso household. But a motion is filed to reconsider, and the next hearing is Aug. 20.
Back in June, a Kane County judge quashed the arrest of a Geneva man charged with allowing an underage drinking party at his home during Homecoming weekend in October 2011. Now the Kane County State's Attorney's Office has filed a motion to reconsider that ruling, and the next hearing is scheduled for Aug. 20, according to the Kane County 16th Circuit Court website. Michelle Caruso, the wife of defendant Robert Caruso, said Judge M. Katherine Moran on June 7 upheld a motion to quash evidence, based on an illegal search. That ruling had not been reported on Geneva Patch until now. “It is hereby ordered defendant Robert M. Caruso’s motion to quash arrest and suppress evidence be and hereby is granted,” Caruso read from court documents. …

The Batavia teen accused of throwing two underage drinking parties in two days is out of jail. A total of $1,650 was posted for Andrew Pederson, 19, to leave the Kane County Jail on Wednesday night. The amount was the required 10 percent of the $16,500 bail set by Judge Allen Anderson on Monday. Pederson is charged with one felony count of criminal damage to government-supported property—a Batavia Police squad car—and several misdemeanor charges tied to two underage drinking parties. Pederson's case will be in court next on July 25 for a status hearing, according to court records. 19-year-old Andrew Pederson remains in the Kane County Jail following two incidents at the east-side home where he lives.
A Kane County judge on Monday set bail for a 19-year-old Batavia man following two police-reported underage drinking parties at his house. Andrew P. Pederson is being held on $16,500 bail, according to county court records. To apply for bond and be released, Hayes or someone else needs to pay 10 percent of the bail, or $1,650. A separate $46 bond fee must also be paid. Batavia Police on Saturday and Sunday reported to Pederson's residence on the 800 block of Pottawatomie Trail for underage drinking parties. The Batavia teen behind Saturday’s underage drinking party was sent to jail after he held another drinking party late Sunday night, according to police and court records. Andrew Pederson, 19, was sent to the Kane County Jail early Monday morning. He faces several charges stemming from Sunday’s party, including criminal damage to a police vehicle and residential delivery of alcohol to a minor. Geneva Police Reports: Nicole Wiesner, the 20-year-old Genevan who twice was involved in single-car crashes in recent weeks now faces additional charges of alcohol consumption by a minor.
Nicole K. Wiesner, 20, the young woman involved in two recent single-car crashes, was arrested at around 3:29 a.m. June 22 along with a 19-year-old friend on charges of alcohol consumption by minor. According to the complaint with the 16th District Circuit Court, Wiesner and Brittany Maberry of Batavia “knowingly consumed an alcoholic liquor” at a residence in the 800 block of Britta Lane, Geneva. Wiesner’s address also is in the 800 block of Britta Lane. Both have a court date of Aug. 7 at the Kane County Branch Court, 530 S. Randall Road, St. Charles.
