Batavia Police Report 2 Batteries, Including 1 Arrest

The following information was supplied by the Batavia Police Department. Where arrests or charges are mentioned, it does not indicate a conviction.

Two batteries were part of the Batavia Police Department reports between March 23 and March 30, 2013. One involved an arrest, the other was an incident at a nail spa that was resolved without an arrest. Battery—Batavia police arrested Daniel M. Rubio, 50, of Batavia on battery charges following an incident around 1:49 p.m. March 30 in the 100 block of Church, reports said. Rubio posted $150 bond and has a court date of May 14, reports said. Battery—Police responded to a battery report at Paris Nail Spa, 11 S. Randall Road, at around 7:44 p.m. March 27, reports said. Two subjects were involved and each gave officers a conflicting story. Court Watch: Batavia Man Denies Sex Assault Accusations

A Batavia man accused of sexually assaulting a woman and then driving her to the hospital has denied the charges against him, court records show. Michael Jett was arrested in June by Batavia Police on multiple counts of aggravated criminal sexual assault, unlawful restraint and battery in connection to incidents in late May and early June. Jett has been held in Kane County Jail on $3 million bail since police took him into custody after hospital workers called police when the woman was brought in for treatment. Jett was arraigned during a Sept. 5 hearing and is scheduled to return to court Oct. 10, records state. Court Sentences Man Who Damaged Batavia Cemetery to Community Service

A police officer testified that the man was on the phone with his girlfriend at the time of the cemetery car crash, according to media reports.

A 27-year-old Elgin man received a community service sentence Thursday in connection with his involvement in damaging a Batavia cemetery. Judge Katherine Moran said Kevin A. Malone must serve 250 service hours and pay $1,700 in fines, the Kane County Chronicle reports. Malone, of the 1600 block of Mark Avenue, was arrested on May 21, 2011, after losing control of his vehicle, entering the West Batavia Cemetery and striking several headstones, according to a Batavia Police report. A total of 12 headstones sustained damage, the Daily Herald said. The West Batavia Cemetery is located off of Route 31 just south of Morton Street.
