Wrongful Death Suit Filed over Fatal Crash Outside Batavia

A wrongful death suit has been filed in Cook County Circuit Court against the Evanston woman whose vehicle struck and killed a North Aurora man biking in Batavia Township near Batavia itself on June 27, the Beacon News reports

According to the paper, Linda Rusk, an administrator for the estate of deceased Richard White, is suing 26-year-old MaMaxima Corazona Cardino Ty, claiming negligence in her failing to take evasive action to avoid White’s bike. 

The suit is seeking an unspecified amount of damages, the paper said.

White, 50, of the 1400 block of Fechner Circle in North Aurora, was northbound on Nelson Lake Road near the entrance to the Dick Young Forest Preserve when a northbound 2009 Nissan Rogue, driven by Ty, 26, of the 2100 block of Howard Street in Evanston, failed to swerve around the bicycle, striking its rear tire.

White, who police said was not wearing a helmet but was apparently wearing headphones, was thrown from the bicycle and later pronounced dead at Mercy Center Hospital in Aurora; Ty was uninjured and was cited with failure to reduce speed to avoid an accident.
