Movie Theater Masturbator Gets Supervision for Public Indecency

South Elgin man was arrested in August 2013 after he was seen pleasuring himself at the Charlestowne 18 Theatres.

A South Elgin man was arrested Aug. 16, 2013 after he was seen masturbating in a local movie theater has been sentenced to supervision after pleading guilty to public indecency, the Kane County Chronicle reports.


Citing Kane County Court records, the Chronicle reports that Kenneth Ray Rutherford, 71, pleaded guilty Jan. 16 before Judge Elizabeth Flood, who sentenced him to supervision. He is due in court next on July 17, 2014.


The Chronicle reports that a related disorderly conduct charge was dismissed.

St. Charles Patch reported in August that Rutherford, of the 200 block of West Quarry Street, South Elgin, was seen pleasuring himself in the the upper level of the Charlestowne 18 Theatres, 3740 E. Main St.


St. Charles police said at the time that the theater manager of the theaters called police after witnessing the incident, which occurred during the lunch hour.
