Man Struck By Car on Fabyan Continues Treatment, Officials Say

Here is the police crash report from the Jan. 11 car vs. pedestrian incident.

The 48-year-old man that was struck by a car on Fabyan Parkway earlier this month continues to be treated at Delnor Hospital, officials said.

The man was admitted to Delnor Hospital on Jan. 11 and was still being treated late last week, a Cadence hospital spokesman confirmed. Cadence is the health care system that operates Delnor Hospital.

When asked for a condition report, the spokesman said HIPPA law restricts what type of information the hospital is allowed to disclose, with respect to patient privacy.

The man was in a westbound lane of Fabyan Parkway south of Allen Drive when he was struck by a red 2011 Honda Accord at 6:32 p.m. Jan. 11, according to a Batavia police crash report. The Honda's driver, a 31-year-old Aurora woman, was cited for operating an uninsured vehicle, the report said.

The man that was struck is from Spokane, Wash., but recently moved to Geneva, according to police and reader reports. A crash report lists an address for the man on the 700 block of Tanager Lane. His home is less than a half-mile from where the crash took place.

Crash Narrative

The Aurora woman said she was traveling westbound on Jan. 11 in the median side lane on Fabyan Parkway. She continued on Fabyan at Allen Drive when she , according to the crash report.

"The driver of unit one (the Accord) stated (the man) was wearing dark clothing, the street was not well illuminated, and she did not see him until moments before impact," the report said.

The woman attempted to swerve into the curbside (right) lane to avoid impact, but the front driver's side portion of her vehicle still struck the man.

The man was unconscious after the crash and immediately transported to Delnor Hospital by the Geneva Fire Department.

"At the time of report, (the man) was still unable to offer his story of events," the report said.

The report did not indicate the speed of the vehicle at the time of the crash. The area of Fabyan where the crash occurred has a posted speed limit of 40 mph.

The driver's side front part of the Accord was the point of first contact, and most of the driver's side was also damaged in the crash. The damage to the Accord was consistent with the Aurora woman driver's story of events, the report said.

There was over $1,500 of damage to any one person's vehicle or property, according to the report. The Accord was towed from the scene.

Witness

A 44-year-old St. Charles man was driving two cars behind the Aurora woman's vehicle. He said the man wore dark clothing and the street was dark at the location of the crash. The crash occurred at 6:32 p.m. and the sky had been dark for over an hour prior to the crash.

The responding officer noted street lights on the south side of Fabyan Parkway in front of a Holmstad building and near the bike path. He did note that there were no street lights present to illuminate the north side of Fabyan Parkway at Allen Drive.

The area of the crash is not a direct four-way crossing. Fabyan crosses Allen Drive to the north; slightly southeast of this is the intersection of Fabyan and River Rock Road. The road is a private drive that goes onto the Holmstad retirement community property.

Batavia Patch took photos at the intersection the week after the crash. There is no visible crosswalk leading from River Rock Road on the south to Allen Drive on the north side of Fabyan.

A Feb. 19 court date in connection to the citation was assigned to this case.
