Batavia Police: Thanksgiving DUI, Crowd Control, Alleged Fraud on Craigslist

The following arrest information was supplied by the Batavia Police Department. It does not indicate a conviction.

 responded to the following incidents on Nov. 23 and in the early-morning hours of Nov. 24.

Some of the notable incidents are listed first in chronological order, starting on the afternoon of Nov. 23:

Nov 23

3:43 p.m.—Fraud

An incident of fraud was reported on the city's southwest side.

A resident on the 2500 block of Kane Lane responded to a Craigslist advertisement in which a subject offered to "Hang Christmas lights," according to a police report.

The subject received a $250 check and left the area to "get supplies," according to the report.

The person never returned after taking the check. That check was cashed within minutes after leaving the premises.

No further information was available on this incident.

Nov. 24

1:56 a.m.—DUI-Alcohol

A 30-year-old North Aurora man is headed to court after a run-in with police on the west side.

Daniel Bydalek, 50 S. Juniper Drive, North Aurora, was on the 800 block of Millview Drive. He was cited with the following:

  • DUI: B.A.C. of .08 or more
  • DUI: Alcohol
  • Speeding
  • Improper lane usage

Bydalek posted his driver's license and I-Bonded out. He was released with a court date of Dec. 28.

2:04 a.m.—Assist Other Agency (Geneva Police)

A Batavia police officer headed north to assist the Geneva Police Department with an incident in that city's downtown area.

The officer assisted with crowd control at 100 N. Second Street., Geneva.

from Patch readers of a fight at or in the vicinity of Old Towne Pub in the early morning hours of Nov. 24. The pub is about one block south of 100 N. Second St.

There were about 150 people in the area and three altercations that police had to deal with, according to Nash. A couple ordinance tickets were issued due to the incident.

The incident was logged as 'Disturbance' by Geneva Police, according to the Batavia Police report.

2:05 a.m.—Domestic Battery

Two subjects were involved in an incident of domestic battery on the city's west side.

The subjects were in a verbal dispute that turned physical at , according to a police report.

There were no visible injuries on either party, and neither party complained of any injuries, according to the report.

Illinois Domestic Violence Act paperwork was issued in this incident.

2:43 a.m.—Domestic Battery

Two subjects were reported to be in an incident of domestic battery on the city's east side.

One subject left for the night during the incident, which happened at .

No further police assistance was needed.

3:53 a.m.—Suspicious Incident

Items were reported moved around in an apartment on the 100 block of North Batavia Avenue.

No further information was available on this incident.

1:29 a.m.—Car Crash: Property Damage

A car crash was reported at North Kirk Road and East Fabyan Parkway.

No citations were issued in this incident.

8:40 a.m. —Criminal Damage To Property

A mailbox was reported damaged on the city’s east side.

A blunt object was used to damage the mailbox, which is located on the 1200 block of Trillium Court. The estimated cost to repair the mailbox is $50, according to a police report.

9:58 a.m. —Criminal Damage To Property

An east-side home reported damage to their mailbox, post and Christmas lights to the residence.

The damage occurred sometime between 8:30 p.m. Nov. 22 and 8 a.m. Nov. 23, according to a police report. The residence is located on the 1100 block of Giese Road.

The estimated cost to replace the damage is $100, according to the report.

1:20 p.m.—Car Crash: Property Damage

A car crash was reported in the parking lot of a business on the 1900 block of West Wilson Street.

No citations were issued in this incident.

1:23 p.m.—Accidental Damage

Someone reported damage to his or her vehicle at a west-side business.

The person observed scratches on the passenger-side view mirror on the 2100 block of Main Street, according to a police report.

No further information was available on this incident.

2:53 p.m.—Criminal Damage to Property

Property damage was reported at , 813 Mark Twain Trail, on the city's east side.

Grafitti was found on both sides of the park sheds located west of , 1501 S. Raddant Rd. Red and black paint was used.

Damage to city property reports were completed. The cost to repair the damages was unknown at the time of the police report.

3:26 p.m.—Warrant Service

A 34-year-old St. Charles man is headed to court after an incident on the city's east side.

Jose L. Garcia, 1618 Indiana St., St. Charles, was arrested on a Kane County Sheriff's Office warrant.

$500 bond was posted (10 percent of the total bond), and Garcia was released with a court date of Jan. 15.

Batavia Police also responded to an armed robbery that occurred at about 8:40 p.m. Nov. 23 at the west-side Subway restaurant, 13 S. Randall Road. This incident was previously reported in a separate post. To read our full report on the robbery, click .
