(UPDATED) Batavia Police: Domestic Battery, Warrants, Crashes

The following arrest information was supplied by the Batavia Police Department. It does not indicate a conviction.

Batavia Police responded to the following incidents on Oct. 27 and Oct. 28. Here they are in chronological order:

Oct. 27

11:28 a.m.—Warrant Service

A 20-year-old St. Charles man was transported to the Kane County Jail after an incident at the Batavia McDonald’s, 125 W. Wilson St.

Nicholas L. Janacek, 214 Walnut St., St. Charles, had two warrants, according to a police report.

12:44 p.m.—Car Crash: Property Damage

A 16-year-old Batavia male was cited for failure to reduce speed to avoid an accident after an incident on the west side.

The teen struck a brick mailbox at 1111 Averill Drive while driving a vehicle. The mailbox was completely destroyed, according to the report.

The teen was traveling southbound on Averill Drive from westbound Towne Avenue. He told police that he looked down at his phone and then left the roadway. That's when he struck the mailbox.

This incident occurred about 100 ft. south of the Averill Drive and Towne Avenue intersection.

1:57 p.m.—Car Crash: Property Damage

A 36-year-old Kent, IL, man reportedly swerved into a lane and stuck another car on Route 31, according to a crash report.

James Eversoll said he was traveling northbound on Route 31 at Monticello Road in the curb lane (outside lane).

Eversoll looked left for an address when he struck a blue 1998 Volkswagen Bug in the next lane. Karina Escamilla, 17, of Elgin was the driver of the Bug.

Escamilla said Eversoll's green 1998 Ford Escort swerved into her lane, striking her right front corner panel. Escamilla was also traveling northbound on Route 31 at Monticello Road. She was in the inside lane next to Eversoll.

A 20-year-old Elgin woman driving in a separate vehicle was a witness to the incident. The woman was driving behind Eversoll—she saw him move in Escamilla's lane and strike her vehicle.

4:09 p.m.—Well-Being Check

A 47-year-old Batavia man is headed to court after an incident on the city's east side.

Brian B. Brooks, 448 Webster. St., was cited for the following:

  • Operating an uninsured motor vehicle
  • No valid driver's license

Police made contact with Brooks at Kirk and Giese roads, according to a report. He was released on a notice to appear with a court date of Dec. 13.

Brooks was transported to Delnor Hospital. The report did not specify a reason for the transport.

4:43 p.m.—Domestic Battery

Two subjects were reportedly involved in an incident of domestic battery at .

One subject left prior to a responding officer's arrival. The officer observed no signs of a physical altercation.

A complaint was not signed.

4:47 p.m.—Car Crash: Property Damage

A 56-year-old Batavia woman was cited for failure to yield after an incident on the city’s west side.

Frieda L. Schnell ran her car into the side of another car heading westbound on Main Street, according to a crash report. Schnell was north of Main Street on Deerpath Road and pulled out southbound to cross Main Street.

Schnell observed a police car pass by on Main Street heading eastbound. She then saw a red 2009 Toyota Camry on westbound Main Street at Deerpath Road. Schnell thought the Camry had a right-turn signal on to turn onto northbound Deerpath Road.

Schnell then pulled her green 2001 Audi TT out to cross Main Street and states she was struck by the Camry.

The Camry’s driver, Katherine M. Brennan of Cortland, 48, said she did not use her turn signal to turn northbound onto Deerpath Road.

Brennan was westbound on Main Street approaching Deerpath Road when she slowed down and pulled toward the shoulder because of the passing police car with lights and sirens. After the police car went by, she pulled onto the traffic lane and proceeded westbound on Main Street.

Brennan said Schnell pulled off of southbound Deerpath Road and ran into the side of the Camry.

5:05 p.m.—Car Crash: Property Damage

A 59-year-old driver from Montgomery was cited for improper backing and operating an uninsured vehicle after an incident on the city’s northeast side.

Agustin Duran struck a Bartlett woman’s car with his rear bumper at the intersection of Kingsland and Olympic drives, according to a crash report. Joan M. Sweetman’s car sustained minor front bumper damage.

Duran was attempting to back onto Olympic Drive from Kingsland and did not know that another vehicle was behind him, according to the report.

Duran and Sweetman’s vehicles were each traveling northbound on Kingsland Drive at Olympic Drive. Duran was driving ahead of Sweetman. Duran came to a stop on Kingsland just past Olympic Drive to try to back up on Olympic, the report said.

Oct. 28

2:06 a.m.—Warrant Service

A juvenile from Aurora was taken into custody at the Batavia Police Department, 100 N. Island Ave.

The juvenile was transported to the Kane County Juvenile Justice Center, according to a police report. Further information, including where the juvenile had a warrant, was not included in the report.
