Batavia Police: Theft, Fraud, Drug Items in Bathroom

The following arrest information was supplied by the Batavia Police Department. It does not indicate a conviction.

Batavia police officers responded to the following incidents in town on Dec. 6.

Here they are in chronological order:

12:44 a.m.—Traffic Arrest

A 40-year-old Aurora man is headed to court after an incident on the city's east side.

Jose R. Rubio-Tellez, 649 Palace St., was cited for no valid drivers license and improper use of registration, according to a police report. The incident occurred on Kirk Road and Wind Energy Pass.

Rubio-Tellez posted $150 bond and was released with a court date of Jan. 17.

4:23 p.m.—Retail Theft

A theft was reported at the Batavia Kohl's, 251 N. Randall Road.

4:49 p.m.—Fraud

Midland Credit reportedly called someone on Cherry Drive for $600 in delinquent payments to T-Mobile in Providence, RI, according to a police report.

5:11 p.m.—Child Custody Dispute

This incident was reported on the 200 block of Kane Lane on the city's southwest side, according to a police report.

5:59 p.m.—Credit Card Fraud

A suspect offender bought some pricey gift cards on the city's west side.

The suspect purchased two gift cards worth $150 each and another card worth $100 from the Batavia Chuck E. Cheese, 511 N. Randall Road, according to a police report.

The suspect made the purchases without authorization from the owner of the card.

6:43 p.m.—Traffic Arrest

A 32-year-old St. Charles man is headed to court after an incident on the city's north side.

Warren M. Fugiel, was cited for driving while license suspended. The incident occurred on East Fabyan Parkway and Nagel Boulevard.

Fugiel I-bonded and was released with a court date of Jan. 10.

7:20 p.m.—Accident: Property Damage

An accident was reported at North Batavia Avenue (Route 31) and West Fabyan  Parkway.

8:28 p.m.—Open Door/Window

An empty apartment caused some alarm on the city's west side.

An officer responded to the 900 block of Lorlyn Circle and noted a unit's door secured and door handle removed, according to a police report.

Entry was made and the apartment appeared to be vacated. Maintenance responded and confirmed the condition of the apartment.

9:34 p.m.—Criminal Damage to Property

A 21-year old Batavia man was placed under arrest after punching holes in a wall.

Neal R. Crowder threw the punches at his listed address on the 1400 block of Fagan Court, according to a police report.

Crowder was transported to the Batavia Police Department for processing. He was then taken to the Kane County Jail for bond call.

10:01 p.m.—Info for Police

A witness at a Batavia gas station told an officer about an ongoing problem with some offenders.

Over the past few weeks, the offenders use the washroom at Kicks Phillips 66, 200 E. Fabyan Parkway, and leave behind drug paraphernalia, according to a police report.

The offenders denied any drug use.

The bathroom was searched and a plastic bag with syringe caps, a metal tin with fresh burn marks and a small cotton swab was found. Police were unable to search the vehicle due to it being cluttered with items—it would have been unsafe to search for needles, the report said.

The offenders were told not to return to the gas station, or they would be arrested.
