Batavia Police: Aggravated Battery, BHS Truancy, Computer Tampering

The following arrest information was supplied by the Batavia Police Department. It does not indicate a conviction.

Batavia police officers responded to the following incidents on May 3 and early morning May 4. Here they are in chronological order:

May 3

10:10 a.m.—Fraud

A scam claiming that someone won money was reported from the Holmstad, 700 W. Fabyan Parkway.

1:18 p.m.—Harassment

An incident of harassment was reported at Batavia High School, 1201 Main St. No further information was available.

1:19 p.m.—Aggravated Computer Tampering

A juvenile at Batavia High School was processed after an incident of computer tampering, according to a police report. A formal station adjustment was made.

1:31 p.m.—Truancy (Desk Report)

A juvenile at Batavia High School was involved in an incident of truancy, according to a police report. The school's police liaison was advised.

4:03 p.m.—Car Crash: Property Damage

A collision was reported at 18 N. Prairie St. No citations were issued.

4:28 p.m.—Aggravated Battery

A 19-year-old Batavia man was taken to jail after an incident on the east side.

Richard D. Smith was arrested for aggravated battery against a peace officer and resisting or obstructing a police officer, according to a police report. The incident occurred on the 700 block of North Van Buren Street.

Smith was also cited for the following:

  • Improper signal
  • Disobeyed stop sign
  • Fleeing or attempting to elude police officer
  • Driving while license suspended
  • Operating an uninsured motor vehicle
  • Disobeyed a stop or yield sign

Smith was processed and transported to the Kane County Jail for bond call.

5:22 p.m.—Domestic Trouble

Two subjects were involved in a family dispute on the west side, according to a police report.

The subjects were separated for the night.

5:58 p.m.—Assist Ambulance

A subject on the 400 block of South Jackson Street was treated on scene by medics. No further information was available at the time of this report.

7:30 p.m.—Traffic Arrest

A 23-year-old Elgin man is headed to court after an incident on Batavia's east side.

Cesar A. Hernandez, of the 300 block of Ryerson Avenue in Elgin, was cited for no valid driver's license and improper lane usage. The incident occurred at Kirk Road and Chillem Drive, according to a police report.

Hernandez was released on personal recognizance. He was given a court date of June 12.

10:37 p.m.—Runaway

A runway juvenile was reported on Batavia's west side.

Information on the juvenile was entered into the LEADS system.

May 4

12:05 a.m.—Traffic Arrest

A 25-year-old St. Charles man is headed to court after an incident on the east side.

Oscar M. Garcia-Martinez, of the 1600 block of Indiana Street, was cited for the following:

  • No valid driver's license
  • Operating an uninsured vehicle
  • Driving while license suspended

Garcia-Martinez was also given a warning citation for driving with one headlight, according to a police report. The incident occurred at Kirk Road and Hubbard Avenue.

Garcia-Martinez was released on personal recognizance. He was given a court date of June 19.

2:48 a.m.—Car Crash: Property Damage

A driver from Maple Park hit a tree on Batavia's west side.

The driver and a passenger were transported to Delnor Hospital, according to a police report. The incident occurred on the 300 block of North Randall Road.

A damage to city property report was completed. No citations were issued in this incident.
