Batavia Man Pleads Guilty to Growing Pot in His Home

The 38-year-old is sentenced to two years probation, community service and a $4,995 fine.

A 38-year-old Batavia man who admitted to growing 21 marijuana plants in his Viking Court home was sentenced to two years probation and a $4,995 fine, the Daily Herald reports.

Jeremy Garrity, of the 600 block of Viking Court, must also complete 30 hours of community service under the plea agreement OK'd by Judge James Hallock.

Harry Hitzeman's report in the Daily Herald says Garrity could face a felony charge if he violates probation. That would result in a possible five-year sentence.

Kane County Lt. Pat Gengler told the DH that a police unit found the 21 plants and about 48 grams of marijuana in Garrity's home during a search on Jan. 31.

The Kane County Clerk's eServices Portal indicates that Garrity was arrested in May on charges of driving under the influence of alcohol, carrying and possession of a firearm, illegal transportation of alcohol, improper traffic lane usage and failure to yield to an emergency vehicle. For those charges, he has a status hearing set for Aug. 19 at the Kane County Judicial Center.
