Apparent U-Turn Ends in Accident With Injuries on Kirk Road: Batavia Police Reports

The following information was supplied by the Batavia Police Department. Where arrests or charges are mentioned, it does not indicate a conviction.


A 37-year-old Hampshire woman was injured after a crash at around 9:44 p.m. Aug. 31 on South Kirk Road, about 150 feet south of Giese Road, according to a police report collected Tuesday in Batavia.

A Mini Cooper driven by Kathleen Smith collided with a Ford Fusion driven by Daniel Eder, 29, of Batavia after the Mini Cooper merged in front of the Fusion while driving south on South Kirk Road “in what appeared to be an attempt to make a U-Turn,” reports said.

The Fusion’s front bumper struck the front driver-side door and fender, causing the Fusion to go across the northbound lane of traffic and into a ditch on the east side of the roadway, reports said. The Mini Cooper came to rest with the front end of the vehicle over the east curb of the roadway.

Smith told police she could not recall any details of the crash, but at Delnor Hospital she agreed to a preliminary breath test which indicated a breath-alcohol content of .000.

Smith was issued a ticket for an illegal lane change and has a court date of Oct. 8.
